   OEM Air Compressor Corporation (OEM) warrants that, under normal use and service, if properly stored, handled, operated and maintained with Genuine OEM replacement filters and oil, its stationary Air Compressor’s air end, will be for the air ends lifetime. One year parts and labor on the rest of the machine   beginning 5 days after shipping. One year warranty on all seals installed. In order for this warranty to stay in effect for the complete warranty period the purchaser must purchase from OEM Air Compressor any oil and filters necessary to do a complete oil and filter change every 2,000 hours or 1 year whichever occurs first to commence at the time of start-up.  Should any such defect become apparent within such time, and written notice of each and every such defect promptly provided to OEM Air Compressor, and OEM Air Compressor reasonable determines that any such product is defective in material or workmanship, OEM Air Compressor will, at its option, replace or repair such products.  OEM Air Compressor’s obligation with respect to such products will be limited to repair or replacement.  F.O.B. OEM Air Compressor’s place of business, without any further expense to OEM Air Compressor, and except as expressly provided here in, OEM Air Compressor should not in any event be liable for any other labor, transportation, installation, adjustment or other expenses, which may arise in connection with such products.  Any misuse or abuses of the product (s) void this limited warranty. 

The OEM Air Compressor Warranty does not extend to products not assembled by OEM Air Compressor.  As to such products by others, purchasers will be entitled to proceed only upon terms of that particular Manufacturer’s Warranty.  The warranty does not apply to defects in materials provided by purchaser or design stipulated by purchaser.  IN NO EVENT WILL, OEM AIR COMPRESSORS BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; however, arising whether in warranty, strict liability, contact, tort, negligence or otherwise including but not limited to loss of profits or revenue, loss of total or partial use of the products, facilities or services, downtime costs, or claims of the Purchaser for such or other damages whether on account of products furnished hereafter or delay I delivery thereof services performed upon or with respect to such products.  OEM Air Compressor’s liability on any claim whether in warranty, strict liability, contact, tort, negligence or otherwise for any loss or damage arising out of, connected with, or resulting from this contact or the performance or breach thereof, or form design, manufacture, sale, delivery, resale repair, replacement, installation, technical direction of installation, inspection, servicing, operation or any use of a product covered by or furnished under this contract will in no case exceed the purchase price allowable to the product or part thereof which give rise to the claim.
